President Moon Jae-in has nominated Mun Moo-il, head of the Busan High Prosecutors’ Office, as the new prosecutor general. The presidential office said, “Given that he is widely trusted by prosecutors, Mun is the right person to stabilize and reform the prosecution.”
문재인 대통령이 문무일 부산고검장을 새 검찰총장 후보로 지명했다. 청와대는 이와 관련해 ``문 후보자가 내부의 신망이 두터워 검찰 조직을 조속히 안정시키고 검찰 개혁을 훌륭히 수행할 적임자’’라고 밝혔다.
The nominee has won fame for handling fairly high-profile corruption cases involving high-ranking officials, political big wigs and business tycoons. He also led a task force to overhaul the prosecution last year.
문 후보자는 고위 공직자, 정치 거물, 재벌 등이 관련된 부패 사건을 공정하게 다뤄 유명세를 얻었다. 그는 또한 지난해 검찰 개혁 전담반을 이끌기도 했다.
Not surprisingly, the public has given the cold shoulder to the prosecution. That’s why the new administration has prioritized reforming the top law enforcement agency.
검찰을 바라보는 국민들의 시선이 싸늘하다는 것은 새로운 얘기가 아니다. 새 정부가 최고 법집행기관인 검찰을 개혁 대상 1순위로 올린 이유다.
But prosecutors have no one to blame but themselves for this pitiable situation. The prosecution has abused its exclusive rights to indict to shield those in power and its organization. 하지만 이런 한심한 상황으로 몰린 데 대해 검찰은 누구도 탓할 수 없다. 검찰은 기소독점권이라는 막강한 권력을 정권과 조직 보호에 악용해 왔다. 현직 대통령 탄핵이라는 초유의 사태를 야기한 최순실 사건에 대한 책임으로부터도 자유롭지 못하다. 아울러 검사가 관련된 잇단 비리가 드러나 국민들의 분노를 자아내기도 했다.
Against this backdrop, the top prosecutor nominee has much to do. He has to wisely deal with a backlash from prosecutors while weeding out “politicized prosecutors” who maintain cozy a relationship with political power.
이런 상황에서 총장에 지명된 문 후보자는 할 일이 많다. 그는 정치권력과 유착한 `정치 검사’를 솎아내는 과정에서 드러날 검사들의 반발에 현명하게 대처해야 한다.
Mun is also tasked with conducting institutional reforms, including the creation of an independent unit to investigate high-ranking officials. All this requires him to take the lead in putting the prosecution under the knife.
문 후보자에게는 또한 공직자비리수사처 신설 등 제도 개혁의 책무도 지워져 있다. 그는 국민들의 비판을 겸허히 수용하고 검찰 조직에 칼을 대는 데도 앞장서야 한다.
The most important thing at this juncture is to ensure that the prosecution can keep its political neutrality. It is widely known that Woo Byung-woo, the impeached President Park Geun-hye’s senior secretary for civil affairs, frequently contacted senior prosecution officials to influence the investigation of the Choi Soon-sil scandal last year.
이 시점에서 가장 중요한 것은 검찰이 정치적 중립을 지킬 수 있도록 하는 것이다. 지난해 최순실 사건 수사 과정에서 우병우 청와대 민정수석이 검찰 고위층과 수시로 접촉한 것은 널리 알려진 사실이다.
The ex-presidential secretary’s intervention in the prosecution’s investigation was undoubtedly illegal. The nominee, if confirmed as the prosecutor general, should ensure that such shameful incidents don’t happen again. It is natural for the prosecution to serve the people, not those in power.
민정수석의 수사 개입은 엄연히 불법이다. 문 후보자는 국회에서 검찰총장으로 승인을 받으면 이런 부끄러운 일이 다시는 발생하지 않도록 최선을 다해야 한다. 검찰은 권력이 아니라 국민에 봉사하는 조직이기 때문이다.
